Liquidia Corp. (NASDAQ:LQDA) shares are trending on Wednesday night.
Shares of the North Carolina-based biopharmaceutical company edged 0.13% higher to $30.30 in after-hours trading on Wednesday.
In the regular session, LQDA closed at $30.26, down 57.19%, according to Benzinga Pro data.
The stock experienced an elevated trading session on Wednesday. Trading volume rose to 22.95 million shares, nearly 19 times its average volume of 1.21 million shares.
Court Backs UTHR on Key Patent Claims
On Wednesday, a federal court in Delaware ruled that two claims of a patent asserted by United Therapeutics (NASDAQ:UTHR) are valid and infringed by Liquidia, the company said in a press release. The litigation concerns Yutrepia (treprostinil) inhalation powder, Liquidia’s lead product.
The claims cover treating pulmonary hypertension with interstitial lung disease (PH-ILD) using inhaled treprostinil, including dry powder formulations. The remaining asserted claims were found invalid.
United Therapeutics filed the suit under the Hatch-Waxman Act. Both sides must submit a proposed judgment, including proposed remedies, to the court within one week.
Remedy Risk Hangs Over Yutrepia
Liquidia said potential remedies could range from removing the PH-ILD indication from Yutrepia’s label to broader limits on the product’s availability. United Therapeutics has asked the court for an injunction restricting Yutrepia on the market.
The company said it cannot estimate its financial exposure given possible appeals and further proceedings.
Liquidia CEO Roger Jeffs said, “We respectfully disagree with the Court’s decision regarding claims 1 and 14 and are fully prepared to pursue all available appellate options.”
Liquidia also plans to submit a supplement to Yutrepia’s New Drug Application to the Food and Drug Administration to remove PH-ILD from the label.
Yutrepia was approved in 2025 for pulmonary arterial hypertension (PAH) and PH-ILD.
