Hims & Hers Health Inc. (NYSE:HIMS) shares are trading higher on Friday as traders continue to weigh fresh regulatory scrutiny against a generally risk-on tape. Here’s what investors need to know.

What Is Driving Hims & Hers Health’s Stock Today?

The FTC is reportedly preparing a lawsuit alleging Hims & Hers unlawfully shared sensitive customer health data with online advertisers and used deceptive billing and cancellation practices. The report specifically names Meta Platforms and Snap Inc as ad firms tied to the alleged data flow via tracking technologies.

In response, the company said the case ignores evidence it provided during a nearly three-year investigation and that it plans to vigorously defend against what it called “baseless claims.”

Hims is also navigating sentiment headwinds into earnings after Jim Cramer called the stock “controversial” and said he’d rather own Eli Lilly.

HIMS Stock: Critical Levels To Watch

Friday’s bounce is happening from a technically important area: the stock is now just 0.7% above its 100-day SMA ($27.51), while still trading 14.9% below its 20-day SMA ($32.54) and 9.8% below its 50-day SMA ($30.72). That mix usually reads as “trying to base,” but with overhead supply still close enough to cap rallies.

Momentum is the bigger issue right now: MACD is below its signal line and the histogram is negative, which points to upside pressure cooling unless buyers can reassert control. Even with the bullish moving-average backdrop (the golden cross in July), the stock still needs to reclaim the $30.00 area to shift the near-term trend back toward the bulls.
